Terms and Conditions

Effective Date: 01.06.2026.

This Licence Agreement and Terms & Conditions (“Agreement”) govern access to and use of all facilities and services:

(“LaBanya”, “we”, “us”, “our”)

By making a reservation, completing a booking, making payment and/or entering the LaBanya premises, the guest (“Guest”, “you”, “your”) confirms that they have read, understood and accepted these Terms & Conditions.

1. Nature of the Agreement

1.1. Any reservation or purchase made via the LaBanya website, messaging channels, social media or on-site does not constitute a lease, tenancy, or transfer of possession rights.
1.2. All bookings grant a temporary, revocable, non-transferable licence to access and use selected hospitality services within the venue, strictly subject to this Agreement.
1.3. LaBanya is a hospitality venue offering a combined beach, lounge, bar and restaurant experience. The services available for reservation and/or purchase include, without limitation:

  • sunbeds,
  • cabanas,
  • beach seating areas,
  • restaurant dining reservations,
  • and other hospitality services as made available.

1.4. Sunbeds and cabanas may be reserved in advance via the LaBanya website or directly on-site at the venue reception, subject to availability.
1.5. LaBanya reserves the right to:

  • refuse entry,
  • relocate Guests,
  • modify seating allocations,
  • limit occupancy,
  • adjust service availability,
  • or terminate access,
    where reasonably necessary for operational, safety or hospitality reasons.

2. Reservations, Payments & Availability

2.1. Reservations are confirmed only upon successful payment or approved deposit.
2.2. Pricing may vary depending on:

  • seasonality,
  • demand,
  • location within the venue,
  • type of service (sunbed, cabana, restaurant),
  • minimum spend requirements,
  • and special events.

2.3. Unless otherwise stated in writing by LaBanya, all payments are non-refundable.
2.4. LaBanya may adjust or cancel reservations due to:

  • severe weather,
  • unsafe sea conditions,
  • force majeure,
  • operational requirements,
  • private events,
  • technical issues,
  • or regulatory restrictions.

2.5. No refunds apply for:

  • late arrivals,
  • early departures,
  • no-shows,
  • weather conditions,
  • crowd levels,
  • music volume,
  • or subjective experience expectations.

3. Venue Structure & Guest Experience

3.1. The LaBanya experience is divided into three primary hospitality zones:

Beach & Sunbed Area

Relaxed beachfront space with:

  • sunbeds and cabanas,
  • beach lounge seating,
  • beverage service to sunbeds and cabanas,
  • curated beach food menu,
  • informal beach atmosphere.

Beach Bar & Lounge Areas

Social hospitality areas offering:

  • cocktails and beverages,
  • light food service,
  • casual seating and ambient experience.

Restaurant Area

Dedicated dining space offering:

  • table service,
  • full à la carte menu,
  • structured dining environment.

3.2. The beach food menu consists of selected casual items intended for beach consumption and differs from the restaurant menu.
3.3. The restaurant area is intended for seated dining. Guests may be required to wear appropriate attire when entering this area. Swimwear alone may not be permitted.
3.4. Certain dishes and dining experiences are exclusively available in the restaurant area.
3.5. LaBanya operates a dynamic hospitality model where menu availability, seating, service style and access conditions may vary depending on venue zone and operational requirements.

4. Guest Conduct & Venue Rules

4.1. Guests are expected to behave respectfully towards staff, other Guests and the venue environment.
4.2. The following are strictly prohibited:

  • illegal substances,
  • violent or disruptive behaviour,
  • harassment or discrimination,
  • damage to property,
  • unsafe conduct,
  • unauthorised commercial activity,
  • external food or beverages unless permitted.

4.3. Excessive intoxication or behaviour that disrupts the guest experience may result in removal without refund.
4.4. Guests acknowledge that LaBanya is a live hospitality environment with:

  • music,
  • beach activity,
  • weather exposure,
  • crowd dynamics,
  • and ongoing service operations.

5. Photography, Video Recording & Promotional Use

5.1. LaBanya may capture photography and video recordings across all areas of the venue for the purpose of promoting and representing the hospitality experience, including beach, cabanas, bar, lounge and restaurant areas.
5.2. The purpose of such content is to present the general atmosphere and experience of the venue. Photography is not intended to interfere with the privacy or enjoyment of Guests.
5.3. Photography and video recording may occur in publicly accessible areas during normal operations, events or promotional activities.
5.4. By entering the venue, Guests acknowledge that they may appear incidentally in photographs or video recordings as part of general atmosphere, crowd scenes, background activity or venue ambience.
5.5. Guests acknowledge that by making a reservation, completing a booking, making payment and/or entering the LaBanya premises, they grant LaBanya a non-exclusive, worldwide, royalty-free licence to use photographs and audiovisual recordings in which they may appear incidentally for the purpose of:

  • marketing and advertising,
  • social media content,
  • branding and promotional materials,
  • PR and editorial publications,
  • and other hospitality-related promotional activities.

5.6. Such content may be used across:

  • social media platforms,
  • websites,
  • digital advertising,
  • printed promotional materials,
  • and third-party editorial features.

5.7. LaBanya will make reasonable efforts to ensure content is appropriate and respectful and will avoid:

  • intrusive close-up depictions,
  • misleading or inappropriate representations,
  • or content that may reasonably harm a Guest’s dignity or reputation.

5.8. LaBanya shall not knowingly use identifiable images of minors for promotional purposes without appropriate parental or legal consent.
5.9. Guests who do not wish to appear in content may notify staff or on-site photographers, and reasonable efforts will be made to accommodate such requests where operationally feasible.
5.10. Incidental or background inclusion in venue imagery may not always be avoidable due to the nature of a live hospitality environment.

6. Limitation of Liability

6.1. LaBanya shall not be liable for:

  • loss or theft of personal belongings,
  • injuries or accidents,
  • weather exposure,
  • allergic reactions,
  • third-party actions,
  • service interruptions,
  • or indirect damages.

6.2. Guests are responsible for personal belongings at all times.
6.3. Minors must be supervised by adults at all times.
6.4. Use of the venue is at Guest’s own risk.

7. Intellectual Property

All LaBanya branding, content, visuals, menus, photography, video and materials remain the property of LaBanya or its licensors and may not be used commercially without written permission.

8. Privacy & Data Protection

LaBanya processes personal data in accordance with applicable data protection laws, including GDPR.

9. Right to Refuse Service

LaBanya reserves the right to refuse entry, cancel reservations, or remove Guests where necessary to ensure safety, maintain venue standards, or protect staff and Guests.
No refund applies where due to Guest behaviour or breach of terms.

10. Force Majeure

LaBanya is not liable for disruptions caused by events beyond reasonable control, including:

  • extreme weather,
  • sea conditions,
  • technical failures,
  • government actions,
  • or similar events.

11. Governing Law

This Agreement is governed by the laws of the Republic of Croatia.

12. Acceptance of Terms

By making a reservation, completing payment, or entering the venue, the Guest confirms acceptance of these Terms & Conditions.
